Terms of Service
By using PixArtHome and purchasing pixels, you agree to these Terms of Service. Please read them carefully before making a purchase.
1. About PixArtHome
PixArtHome (pixarthome.com) is a unique creative project where individuals purchase virtual pixels that are physically painted on a real house wall. The project is owned and operated by an individual entrepreneur based in Latvia, European Union.

2. The Service
PixArtHome allows users to:
- Select one or more pixels on a digital map of a real house wall
- Choose a color for each selected pixel
- Optionally provide a nickname, country code, and a short message (max 200 characters)
- Pay a minimum of 5 EUR per pixel
- Have their chosen color physically painted on the real wall
3. Purchases and Payments
3.1 Pricing
The minimum price is 5 EUR per pixel. Users may voluntarily pay more. All prices are in euros (EUR) and include applicable VAT where required.
3.2 Payment Processing
Payments are processed securely by Stripe (stripe.com), a third-party payment processor. PixArtHome does not store your credit card or payment details. By completing a purchase, you also agree to Stripe's Terms of Service.
3.3 Pixel Reservation
When you initiate a purchase, your selected pixels are reserved for 15 minutes. If payment is not completed within this time, the reservation expires and the pixels become available to others.
3.4 Purchase Confirmation
A purchase is confirmed only after successful payment processing. Upon confirmation, your pixels are permanently registered in our database and will be painted on the physical wall.
4. No Refund Policy
All purchases are final and non-refundable. Because each pixel purchase directly corresponds to a physical painting on a real wall — which involves permanent physical work — we are unable to offer refunds once payment has been processed.
By completing a purchase you acknowledge and accept that:
- Your payment is non-refundable
- The pixel location you selected will be permanently painted
- The physical painting may take place weeks or months after purchase, depending on the project timeline
This no-refund policy is consistent with the exception under EU Directive 2011/83/EU Article 16(c) for goods made to the consumer's specifications or clearly personalised.
5. Content Rules
When submitting a nickname, message, or choosing pixel colors, you agree that your content:
- Does not contain offensive, threatening, discriminatory, or illegal material
- Does not infringe third-party intellectual property rights
- Does not contain personal data of third parties without their consent
- Does not promote violence, hatred, or illegal activities
- Is not sexually explicit or inappropriate
PixArtHome reserves the right to remove or modify any content that violates these rules, without refund. In serious cases, we may report violations to relevant authorities.
6. Intellectual Property
All intellectual property rights to the PixArtHome concept, website, design, software, branding, and the collective artwork created on the physical wall belong exclusively to the owner of PixArtHome.
By purchasing a pixel, you do not acquire any intellectual property rights, ownership of the physical wall, or any rights to reproduce the collective artwork commercially.
You retain no rights to the physical wall surface. Your purchase grants you the right to have your chosen color painted at your chosen location — nothing more.
7. Physical Wall and Painting
PixArtHome commits to physically painting all purchased pixels on the real house wall. However:
- The exact painting timeline depends on weather, logistics, and project phases
- The wall may be painted in sections over time
- Minor color variations may occur due to paint mixing and surface conditions
- Once painted, the artwork is intended to be permanent but PixArtHome cannot guarantee perpetual preservation against natural weathering
8. User Responsibilities
You are solely responsible for:
- The accuracy of the information you provide
- Any content you submit (nickname, message)
- Ensuring you have the right to use any content you submit
- All actions taken through your session on the website
9. Limitation of Liability
To the maximum extent permitted by applicable law, PixArtHome is not liable for:
- Indirect, incidental, or consequential damages
- Loss of data or profits
- Temporary website unavailability or technical errors
- Actions of third-party services (Stripe, Cloudflare, etc.)
Our total liability to you shall not exceed the amount you paid for your pixel purchase.
10. Governing Law
These Terms are governed by the laws of the Republic of Latvia and applicable European Union regulations. Any disputes shall be resolved in Latvian courts, unless otherwise required by mandatory consumer protection law in your country of residence.
EU consumers have the right to access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
11. Changes to Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the service after changes constitutes acceptance of the new Terms.

We do not store credit card details. All payment data is handled exclusively by Stripe. We never have access to your full card number, CVV, or bank account details.
3. Public Display of Data
Before completing a purchase, you are explicitly informed and asked to confirm that your nickname, country code, and message may be displayed publicly on the PixArtHome website alongside your pixel location.
By checking the confirmation box during checkout, you consent to this public display. You may request removal of your display name and message at any time by contacting us (this does not affect the physical painting).
4. How Long We Keep Your Data
- Purchase records — kept for 7 years for accounting and legal compliance purposes (required by Latvian law)
- Publicly displayed data (nickname, country, message) — kept as long as the project is active, or until you request removal
- Reservation data — automatically deleted after 15 minutes if purchase is not completed
- Server logs — kept for up to 30 days by Cloudflare

We do not sell your personal data to any third parties. We do not use your data for advertising purposes.
6. International Transfers
Some of our service providers (Stripe, Cloudflare) may process data outside the European Economic Area (EEA). Where this occurs, appropriate safeguards are in place, including Standard Contractual Clauses approved by the European Commission.
7. Your Rights Under GDPR
As an EU resident, you have the following rights regarding your personal data:
- Right of access — request a copy of the data we hold about you
- Right to rectification — request correction of inaccurate data
- Right to erasure — request deletion of your data ("right to be forgotten"), subject to legal retention requirements
- Right to restriction — request that we limit how we use your data
- Right to data portability — request your data in a structured, machine-readable format
- Right to object — object to processing based on legitimate interests
- Right to withdraw consent — where processing is based on consent, you may withdraw it at any time

You also have the right to lodge a complaint with the Latvian Data State Inspectorate (dvi.gov.lv) or with the supervisory authority in your country of residence.
8. Data Security
We implement appropriate technical and organisational measures to protect your personal data, including:
- All data transmitted over HTTPS (TLS encryption)
- Payment data processed exclusively by PCI-DSS compliant Stripe
- Database access restricted to authorised personnel only
- Webhook signatures verified to prevent fraudulent data injection
9. Children's Privacy
PixArtHome is not directed at children under 16. We do not knowingly collect personal data from children under 16. If you believe a child has provided us with personal data, please contact us and we will delete it promptly.
10. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify users of significant changes by posting a notice on the website. Continued use of the service constitutes acceptance of the updated policy.
